Terms of Service for GiftCircles

1. Agreement to Terms

By accessing and using GiftCircles (“the App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the App.

2. Description of Service

GiftCircles is a mobile app that helps users coordinate gift-giving by allowing them to:

• Create and join gift-giving events
• Create and manage gift lists for recipients
• Claim items they intend to purchase for others
• Coordinate with friends and family
• Track purchases and event details

3. Eligibility

You must be at least 13 years old to use GiftCircles. By using the App, you confirm that you meet this age requirement.

4. User Accounts

Account Creation

• Provide accurate and complete information when creating an account.
• You are responsible for maintaining the security of your credentials.
• Do not share your account with others.
• Notify us immediately of unauthorized access.

Account Termination

• You may delete your account anytime via the Profile screen.
• We may suspend or terminate accounts that violate these Terms.
• Upon termination, your access will cease and your data will be deleted in accordance with our Privacy Policy.

5. User Conduct

You agree not to:

• Use the App for any illegal purpose
• Harass, abuse, or harm others
• Impersonate any person or entity
• Upload or transmit malware or harmful code
• Attempt unauthorized access to the App or other accounts
• Scrape, data mine, or use automated tools to collect data
• Interfere with or disrupt the App’s functionality
• Spam or send unsolicited messages
• Violate any applicable laws or regulations

6. User Content

Content You Create

• You retain ownership of events, lists, and items you create.
• You grant us a limited license to store and display your content to operate the App.
• You are responsible for the legality and accuracy of your content.
• Do not upload content that is illegal, offensive, or infringes on others’ rights.

Content Visibility

• Event members can see event details, lists, and participant names.
• Recipients cannot see who claimed items on their lists.
• You control the visibility of lists you create.

7. Free Tier Limitations

The free version of GiftCircles includes up to 3 active events per user. Additional limits may apply and will be communicated in-app. We may modify these limits with reasonable notice.

8. Intellectual Property

Our Rights

• The App’s design, code, and features are owned by us.
• Our trademarks and branding are protected by law.
• You may not copy, modify, distribute, or reverse-engineer the App.

Third-Party Content

• The App may include links to third-party websites or services.
• We are not responsible for third-party content or actions.

9. Privacy

Your use of the App is governed by our Privacy Policy, incorporated by reference.

10. Disclaimers

“As Is” Service

The App is provided “as is” and “as available,” without warranties of any kind, express or implied.

No Guarantee

• We do not guarantee uninterrupted or error-free service.
• We do not guarantee data accuracy or that defects will be corrected.
• Your use is at your own risk.

11. Limitation of Liability

To the fullest extent permitted by law, GiftCircles and its affiliates will not be liable for any indirect, incidental, consequential, or punitive damages, even if advised of the possibility. Total liability shall not exceed $100 or the amount paid by you in the past 12 months, whichever is lower.

12. Indemnification

You agree to indemnify and hold harmless GiftCircles, its affiliates, officers, employees, and agents from any claims, losses, or expenses arising from your use of the App or violation of these Terms.

13. Changes to the Service

We may modify, suspend, or discontinue the App at any time. We may also update these Terms, and we will notify you of material changes through the App or via email.

14. Changes to Terms

We may revise these Terms periodically. Updates take effect when posted. Continued use after changes means you accept them.

15. Termination

By You

You may terminate your account anytime through the Profile screen.

By Us

We may suspend or terminate your access for violations of these Terms, legal obligations, or at our discretion.

Effect of Termination

• Access will cease immediately.
• Account data will be deleted per our Privacy Policy.
• Relevant clauses (e.g., Liability, IP) survive termination.

16. Dispute Resolution

Governing Law

These Terms are governed by the laws of Sweden, without regard to conflict-of-law rules.

Informal Resolution

Before filing a claim, you agree to contact us at support@giftcircles.app to attempt resolution informally.

Arbitration / Class Action

No arbitration or class action waiver clauses are currently in place. We may add these after consulting legal counsel.

17. Miscellaneous

• Entire Agreement: These Terms and the Privacy Policy form the complete agreement.
• Severability: If any term is invalid, the rest remain in effect.
• Waiver: Our failure to enforce a provision is not a waiver.
• Assignment: You may not assign your rights; we may assign ours as needed.
• No Third-Party Beneficiaries: No third party gains rights from these Terms.
• Force Majeure: We are not liable for events beyond our reasonable control.
