1. Agreement to Terms
By accessing or using GiftCircles ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
2. Description of Service
GiftCircles is a mobile application that helps users coordinate gift-giving by allowing them to:
- Create and join gift-giving events
- Create and manage gift lists for recipients
- Claim items they intend to purchase for others
- Coordinate with friends and family
- Track purchases and event details
3. Eligibility
You must be at least 13 years old to use the App. By using the App, you represent and warrant that you meet this age requirement.
4. User Accounts
Account Creation
- You must provide accurate and complete information.
- You are responsible for maintaining the confidentiality of your account credentials.
- You agree not to share your account with others.
- You must notify us immediately of any unauthorized access.
Account Termination
- You may delete your account at any time through the Profile screen.
- We may suspend or terminate accounts that violate these Terms.
- Upon termination, your access will cease and your data will be handled according to our Privacy Policy.
5. User Conduct
You agree not to:
- Use the App for any unlawful purpose
- Harass, abuse, or harm others
- Impersonate any person or entity
- Upload malware or harmful code
- Attempt unauthorized access to the App
- Scrape or data mine the App
- Disrupt functionality
- Send spam or unsolicited communications
- Violate applicable laws
6. User Content
Content You Create
- You retain ownership of the content you create.
- You grant us a limited, non-exclusive license to store and display your content solely to operate the App.
- You are responsible for ensuring your content is lawful and does not infringe on others' rights.
Content Visibility
- Event members may see event details and participant names.
- Recipients cannot see who claimed items on their lists.
7. Free Tier Limitations
The free version of GiftCircles may limit the number of active events or features available. These limits may change with reasonable notice.
8. Subscriptions and Payments
GiftCircles offers optional paid subscriptions that provide access to premium features.
Subscription Plans
Subscription details, including pricing and duration, are displayed within the App before purchase.
Billing
- Payment is charged at confirmation of purchase through the applicable app store.
- Subscriptions automatically renew unless canceled before the end of the current billing period.
- Renewal charges occur at the price and duration selected at the time of purchase.
- Pricing may vary by region.
Managing and Canceling Subscriptions
You may manage or cancel your subscription at any time through your account settings in the app store from which you purchased the subscription.
Deleting the App does not cancel your subscription.
Free Trials (If Offered)
If a free trial is offered, any unused portion of the trial will be forfeited when you purchase a subscription.
Refunds
Refund requests are handled by the app store through which the subscription was purchased, subject to that store's policies.
9. Privacy
Your use of the App is governed by our Privacy Policy, which is incorporated by reference.
10. Intellectual Property
The App's design, features, branding, and code are owned by GiftCircles and are protected by applicable intellectual property laws.
You may not copy, modify, distribute, or reverse-engineer the App.
11. Disclaimers
The App is provided "as is" and "as available" without warranties of any kind.
We do not guarantee uninterrupted or error-free service.
12. Limitation of Liability
To the fullest extent permitted by law, GiftCircles shall not be liable for indirect, incidental, consequential, or punitive damages.
Total liability shall not exceed $100 or the amount paid by you in the previous 12 months, whichever is lower.
13. Indemnification
You agree to indemnify and hold harmless GiftCircles and its affiliates from claims arising from your use of the App or violation of these Terms.
14. Changes to the Service
We may modify, suspend, or discontinue the App at any time.
15. Changes to Terms
We may update these Terms periodically. Continued use of the App after changes constitutes acceptance of the updated Terms.
16. Termination
We may suspend or terminate access for violations of these Terms or legal requirements.
Certain provisions survive termination.
17. Governing Law
These Terms are governed by the laws of Sweden, without regard to conflict-of-law rules.
18. Dispute Resolution
Before filing a formal claim, you agree to contact us to attempt informal resolution.
